By accessing or using the AI Realty Assistant service ("Service"), available at airealtyassistant.com ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
AI Realty Assistant is a software-as-a-service (SaaS) platform that provides real estate professionals with an AI-powered chat widget for their websites. The Service includes:

You are responsible for all activity that occurs under your account. Notify us immediately at support@airealtyassistant.com if you suspect unauthorized access.
Pricing: The Service offers three subscription tiers:
All tiers begin with a 14-day free trial.
Free Trial: New accounts receive a 14-day free trial. Valid payment information is required to start the trial; your card will not be charged until the trial period ends. The trial is subject to fair-use limits, including a cap of 20 AI lead conversations during the trial period. If you reach this cap before the 14 days are up, you can activate your subscription early from your dashboard to continue using the Service without interruption.
Conversation Limits and Overage: Each tier includes a monthly conversation quota as listed above. Conversations beyond the included quota are billed as overage at $0.05 per conversation for Solo and Team tiers, or $0.03 per conversation for the Brokerage tier. We also enforce a hard monthly conversation cap (approximately 4–5x the included quota) above which your chatbot is paused for the remainder of the month to prevent runaway usage. If you reach the cap, you can upgrade your plan to resume immediately, or wait for the next billing period when the cap resets automatically.
Billing: Subscriptions are billed monthly or annually (depending on your selection) through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis.
Price Changes: We may change our pricing with 30 days' notice. Price changes will take effect at your next billing cycle after the notice period.
Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support@airealtyassistant.com. Upon cancellation, you will retain access to the Service through the end of your current billing period.

We reserve the right to suspend or terminate accounts that violate these terms.
Ownership: You retain ownership of all content you upload to the Service, including property listings, business information, and branding assets.
License: By uploading content, you grant us a non-exclusive, worldwide license to use, display, and process that content solely for the purpose of providing the Service to you.
Responsibility: You are solely responsible for the accuracy and legality of your content. You represent that you have the right to upload and use all content you provide.
Listing Authorization: You represent and warrant that any property listings you upload or advertise through the Service are listings you are licensed and authorized to represent under applicable real estate laws, MLS rules, and your brokerage agreements. You may not use the Service to advertise or solicit leads for listings belonging to another agent or brokerage without explicit written authorization. Violation of this requirement may result in immediate account suspension and may be reported to the applicable real estate licensing authority or MLS.
MLS and Listing Display Compliance: Property listings uploaded to the Service typically originate from a Multiple Listing Service (MLS). MLS rules generally require that any third-party display of MLS-sourced listing data include certain notices (such as "information deemed reliable but not guaranteed") and may require MLS- or brokerage-specific attribution language that varies by MLS. As the licensed MLS participant, you are responsible for confirming your MLS's specific display and attribution requirements and for ensuring your use of the Service complies with them. The Service includes a generic listing-accuracy disclaimer on our hosted chat page; if your MLS requires additional, different, or attribution-specific language, contact us at support@airealtyassistant.com so we can coordinate the appropriate disclosure for your account.
Lead Data: Leads captured through your widget are your data. We process this data on your behalf to provide the Service.
The Service, including its design, features, and technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
The Service integrates with third-party services including:
Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service availability or performance.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
By You: You may terminate your account at any time by canceling your subscription and ceasing use of the Service.
By Us: We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice.
Effect of Termination: Upon termination, your right to use the Service ends immediately. We may delete your data after a reasonable retention period.
We may update these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable federal and state law.
