Terms of Service

1. Acceptance of Terms

By accessing or using the AI Realty Assistant service ("Service"), available at airealtyassistant.com ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Real Estate AI Chatbot is a software-as-a-service (SaaS) platform that provides real estate professionals with an AI-powered chat widget for their websites. The Service includes:

  • An embeddable chat widget powered by artificial intelligence
  • Lead capture and qualification tools
  • Property listing integration and search
  • A dashboard for managing leads, properties, and widget settings
  • Analytics and reporting features

The AI functionality is powered by third-party artificial intelligence services and may not always provide accurate or complete information.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Have a valid invite code (if required)
  • Accept these Terms and our Privacy Policy

You are responsible for all activity that occurs under your account. Notify us immediately at support@airealtyassistant.com if you suspect unauthorized access.

4. Subscription and Payment

Pricing: The Service is available at $299 per month or $249 per month billed annually ($2,988/year), after an initial 14-day free trial.

Free Trial: New accounts receive a 14-day free trial. No payment is required to start the trial. You must provide valid payment information before the trial ends to continue using the Service.

Billing: Subscriptions are billed monthly through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis.

Price Changes: We may change our pricing with 30 days' notice. Price changes will take effect at your next billing cycle after the notice period.

5. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support@airealtyassistant.com. Upon cancellation, you will retain access to the Service through the end of your current billing period.

Monthly Subscriptions:

  • Cancellation takes effect at the end of your current monthly billing period
  • No refunds are provided for partial months of service

Annual Subscriptions:

  • 30-Day Money-Back Guarantee: If you cancel within 30 days of your annual subscription charge, you are eligible for a full refund. Contact support@airealtyassistant.com to request your refund
  • After 30 Days: Cancellations made more than 30 days after your annual charge are not eligible for a refund. You will retain full access to the Service through the end of your 12-month subscription period

Additional Refund Requests: Refund requests outside of the policies described above are handled at our sole discretion. Contact support@airealtyassistant.com with your request.

6. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Upload false, misleading, or fraudulent property listings
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send spam or unsolicited messages
  • Violate any applicable real estate laws or regulations
  • Resell or redistribute the Service without authorization
  • Use automated tools to scrape or extract data from the Service

We reserve the right to suspend or terminate accounts that violate these terms.

7. Your Content

Ownership: You retain ownership of all content you upload to the Service, including property listings, business information, and branding assets.

License: By uploading content, you grant us a non-exclusive, worldwide license to use, display, and process that content solely for the purpose of providing the Service to you.

Responsibility: You are solely responsible for the accuracy and legality of your content. You represent that you have the right to upload and use all content you provide.

Lead Data: Leads captured through your widget are your data. We process this data on your behalf to provide the Service.

8. Intellectual Property

The Service, including its design, features, and technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

9. Third-Party Services

The Service integrates with third-party services including:

  • Stripe for payment processing
  • Anthropic (Claude) for AI chat functionality

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service availability or performance.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • AI responses will be accurate, complete, or appropriate
  • The Service will meet your specific requirements
  • Any defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use of or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to the Service

13. Termination

By You: You may terminate your account at any time by canceling your subscription and ceasing use of the Service.

By Us: We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice.

Effect of Termination: Upon termination, your right to use the Service ends immediately. We may delete your data after a reasonable retention period.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable federal and state law.
